Amicus curiae recommended by Supreme Court Bar Association

Supreme Court had sought amicus curiae on case related to House dissolution

The Supreme Court Bar Association has recommended the names of Senior Advocates Komal Prasad Ghimire and Prakash Bahadur KC as the amicus curiae for the hearing on the writ petition filed against the dissolution of the House of Representatives in the Supreme Court.

The decision to recommend Ghimire and KC as amicus curiae was taken by a meeting of the Supreme Court Bar Association held today. In cases of grave concern there is a trend that the Supreme Court does seek amicus curiae to provide it with suggestions.

Meanwhile, the Supreme Court on June 9 had said that it will announce its verdict on the writ petitions filed against the dissolution of the House of Representatives by the second week of Asadh (June 28). The constitutional bench of the Supreme Court that is hearing the case had also issued an order stating the time that will be provided by both sides to place their arguments. As per the order, both sides will get a total time of 15 hours to place their arguments.

The petitioners will get a maximum time of 12 hours to place their arguments while the government side will get a total of three hours to place its argument, according to the constitutional bench. Each advocate will get a maximum of 30 minutes to place their arguments.

The constitutional bench hearing the writs comprises of Chief Justice Cholendra Shumsher JB Rana and Justices Deepak Kumar Karki, Meera Khadka, Ishwor Prasad Khatiwada and Anand Mohan Bhattarai.

President Bidhya Devi Bhandari, on the recommendation of the government, had dissolved the House of Representatives and announced the dates for mid-term elections on May 22. She had cited that the claims made by Prime Minister KP Sharma Oli, who is also chairperson of CPN UML, and Nepali Congress President Sher Bahadur Deuba to form the government as per Article 76 (5) of the Constitution of Nepal did not hold sufficient ground to confirm that they would win the vote of confidence in the Parliament.
