Government lifts land ceiling for certain businesses

The Ministry of Land Management, Cooperatives and Poverty Alleviation has lifted the land ceiling for industries, enterprises, companies, educational or health institutions, and projects to operate businesses related to the industry, agriculture, hydroelectricity, education, health, or real estate.

As per the ‘Order Related to Exemption on Land Ceiling, 2021’, which was published in the Nepal Gazette on May 17, the abovementioned entities could be granted an exemption if they require land that is more than the current land ceiling. However, these entities will have to submit certain details to the ministry like the type of land they want to purchase and the amount that is beyond the current land ceiling, among others. They will also have to obtain a recommendation letter from the ministry under which their business falls.

After all the necessary documents have been submitted the Department of Land Management and Archive will conduct a field visit of the land that the concerned entity wishes to purchase. The department will also seek details of the land from concerned authorities. After all the necessary formalities have been finalised the department shall recommend the concerned ministry for the purchase process of the land.

However, what has to be noted is the concerned entity must purchase the land within two years of receiving the permission. The Ministry of Land Management, Cooperatives, and Poverty Alleviation has also stated that the land that has been purchased beyond the ceiling can be kept as collateral to obtain loans from banks and financial institutions.
